
Features of MSME Samadhaan – Delay Payment Portal | How to file a case?

MSME Samadhaan is a Portal developed by the Office of DC (MSME), Ministry of Micro, Small and Medium Enterprises where Micro and Small Enterprises (MSEs) can file their applications online regarding delayed payments.
As you may be aware the micro, small, and medium enterprises development MSMED act-2006, contains provisions to deal with cases where the buyer of goods and services from MSEs does not make payment to the supplier for his supplies of goods or services within 45 days of the day of acceptance of the goods/service. In such cases, the micro and small enterprises facilitation council (MSEFC) present in the state can be approached for conciliation and arbitration. If the MSME supplier gets the decree in his/ her favor, the buyer is liable to pay compound interest with monthly rests to the supplier on the payable amount at three times the bank rate notified by the RBI.
If the appellant filing the case is not a supplier and still wishes to file an appeal, he must set aside 75% of the award amount before the court begins deciding any such case.
Who will apply?
Any Micro or small enterprise, Who has valid Udyog Aadhar (UAM) can apply for filing an online application against the buyer/purchaser of goods/services before the relevant MSEFC of his/her State/UT.
Features of MSME Samadhan
- The buyer is liable to pay compound interest monthly to the supplier at a rate which is three times the bank rate notified by the RBI. , it contains provisions to deal with cases where the buyer of goods and services from MSEs does not make payment to the supplier for his supplies of goods or services within 45 days of the day of acceptance of the goods/service
- • Each state government needs to provide
1) notification regarding authority for filing Entrepreneur Memorandum
2) Rules of MSEFC (Micro and Small Enterprise Facilitation Council)
3) Constitution of MSEFC (Micro and Small Enterprise Facilitation Council)
- • Each reference or a case made to MSEFC must be decided within 90 days from the date of making such a reference as per the provisions laid in the act.
- • If the Appellant (not being the supplier) wants to file an appeal, no application for setting aside any decree or award by the MSEFC shall be entertained by any court unless the appellant (not being supplier) has deposited with it, the 75% of the award amount.

- Udyam Registration Number or Udyog aadhaar Number
- The buyer’s details against whom the complaint is to be filed
- Category of buyer
- Name, Address, Mobile of the buyer
- State and District of buyer
- DIC Center or Ministry under the buyer comes
- Total amount received
- Amount Due
- Work order Detail and Invoice Detail
Documents required to file the delayed payment application
- Udyam Registration Number or Udyog aadhaar Number
- Scanned documents of Purchase and sale invoices for which recovery to be made
- Maximum size for document should not be more than 1 MB in PDF Format
- A maximum of three Purchase and Sales invoices can be uploaded.
